High riskCLAIM-07

"Our product is fully climate neutral."

The claim is categorical, but the material shows no full methodology, offset boundaries, or emission scope.

Outcome preview

  • Legal basis: UCPD, Directive 2024/825 (EmpCo), misleading practices
  • Recommendation: specify the emission scope and offset conditions
  • Suggested rewrite: avoid an absolute claim without full justification

Problem and solution

Regulatory pressure grows faster than compliance teams.

Vardic shortens the path from an uncertain claim to a decision you can defend before your legal team, board, and regulators.

Directive 2024/825 (EmpCo) is already in force

From September 2026, environmental claims will be judged far more strictly. This is no longer a matter of image — it is operational and legal.

Manual review doesn't scale

Marketing publishes faster than legal teams can review. The bottleneck grows with every campaign and copy change.

One mistake is a regulatory risk

An unsupported absolute claim or unclear emission offsetting can trigger a costly communication correction.

How it works

Three moves from a claim to a ready decision.

No new heavyweight tool to roll out. Drop in your material, get a report, fix the messaging before it goes live.

FAQ

Frequently asked questions

What is greenwashing?

Greenwashing does not currently have a single legal definition. We understand it as the practice of making unsubstantiated environmental claims that do not reflect the actual impact of a product or company. Such practices can mislead consumers and constitute an act of unfair competition, punishable by, among others, financial penalties imposed by the President of UOKiK (the Polish competition and consumer protection authority).

You can learn more in the educational materials available on the Zanfia platform.

Is the analysis result legal advice?

The tool supports the assessment of communication risk and does not replace professional legal advice. Kałużna Legal accepts no liability for the consequences of using the information contained in the Reports generated by the Vardic tool without prior consultation with our specialists.

Which regulations is the analysis based on?

The analysis is based on local regulations, primarily the Polish Act on Counteracting Unfair Market Practices, which prohibits misleading consumers as to the environmental characteristics of a product. At the EU level, the foundations are Directive 2005/29/EC (UCPD) and the amending Directive 2024/825 (Empowering Consumers).

Additionally, explanatory and interpretive documents published during the work on these regulations are taken into account, including the European Commission's "Answers to frequently asked questions", which clarifies the application of the new requirements arising from the EmpCo Directive.

How does the credit system work?

A single credit allows a full analysis of text up to 1,000 characters excluding spaces. For longer messages, the system automatically draws the appropriate number of units, and if you plan to regularly check very long content, we will prepare an individual quote tailored to your business needs.

Who is Vardic for?

Vardic is intended for any organization that wants to systematically identify and reduce the risk of greenwashing in its communications. Although it may sound trivial, this risk can arise in every market sector — wherever organizations communicate their environmental actions, climate goals, or the characteristics of their products and services. Vardic adapts the scope of the analysis to the specifics of a given organization, taking into account the nature of its activity, its industry, and the type of messages, which makes the tool more accessible across different sectors.

Is my content confidential?

Vardic is designed to analyze publicly available communications and marketing materials. The content you submit is processed in line with GDPR and sent to the AI model solely to analyze it for greenwashing. Your data is not used to train models. Results are retained for 90 days by default and are always subject to human review.

Need a setup where your data never leaves your own infrastructure? Contact your company's system administrator about an on-premises configuration. See our Privacy policy for details.

What happens when I run out of credits?

Once your available units are used up, verification of new messages will be paused until your account is topped up again. You can purchase an additional credit package at any time in the user panel, which lets you immediately resume auditing your marketing materials.

Will I receive a VAT invoice?

Yes, we fully support Polish VAT invoices. We use the secure Stripe payment system. To receive an invoice, enter your full company details and NIP (tax ID) in the Stripe form during checkout. The invoice is generated automatically and emailed to you within a few minutes of a successful payment.
